Terms of Service

These terms apply when you use FairwayWise.com and when you place an order with us. They are written in plain English — no legalese, no surprises. By using this site or placing an order, you agree to these terms.

About FairwayWise

FairwayWise is a curated golf equipment store operating from the United States. We specialize in PGM Golf products. We are independently owned and operated. We are not affiliated with PGM Golf’s parent company — we are an authorized retailer of their products.

Eligibility

You must be at least 18 years old to place an order. By placing an order, you confirm that you are 18 or older and that the payment method you use belongs to you or you are authorized to use it.

Products

We stock genuine PGM Golf products sourced directly from the manufacturer. Key things to know:

  • Product images are taken in-house and show the actual product you will receive. Colors may appear slightly different on different screens — that is a display limitation, not a product difference.
  • Specifications (loft, lie, length, weight, materials) are provided by the manufacturer. We verify key specs on our most popular models, but we rely on PGM’s published specifications for the full catalog.
  • Availability is not guaranteed. If an item you ordered is out of stock, we will notify you within 1 business day and give you the option to wait, switch to a comparable item, or cancel for a full refund.
  • PGM branding: PGM is a registered trademark of PGM Golf. FairwayWise is an independent retailer. Product warranties are provided by PGM; we facilitate warranty claims on your behalf.

Pricing and Payment

  • Currency: All prices are in US Dollars (USD).
  • Price changes: Prices may change without notice. The price at the time you place your order is the price you pay — we will not retroactively charge or refund price differences.
  • Pricing errors: If a product is listed at an obviously incorrect price (e.g., a driver listed at $1.99 due to a data entry error), we reserve the right to cancel the order and issue a full refund. We will notify you before cancelling.
  • Tax: Sales tax is calculated at checkout based on your shipping address and applicable state and local tax rates.
  • Payment methods: We accept major credit cards, debit cards, and PayPal. Payment is processed at the time of order. Your card is charged when you click “Place Order” — not at some later date.

Orders

  • Order confirmation: You will receive an email confirmation immediately after placing your order. This confirms we received your order — it is not an acceptance of the order.
  • Order acceptance: Your order is accepted when it ships. Until then, we reserve the right to cancel for any reason (stock issues, pricing errors, payment verification flags). If we cancel, you get a full refund.
  • Order limits: We reserve the right to limit quantities on any product. This is rare and typically only happens when demand exceeds our ability to fulfill — we would rather limit orders than take your money and make you wait.

Shipping and Delivery

All shipping terms — processing time, rates, delivery estimates, carriers, international policies, customs, tracking, and lost package procedures — are detailed on our Shipping Information page. That page is part of these terms.

Risk of loss passes to you when the carrier delivers the package to the address you provided. If a package shows as delivered but you cannot locate it, follow the steps on our Shipping page — we will help.

Returns and Refunds

All return and refund terms — return window, condition requirements, process, refund timeline, return shipping costs, exchanges, and non-returnable items — are detailed on our Returns and Refunds page. That page is part of these terms.

Intellectual Property

  • Our content: All text, images, graphics, logos, and product descriptions on FairwayWise.com are our property or used with permission from PGM Golf. You may not copy, reproduce, or republish our content without written permission.
  • Product images: Our product photos are taken by us. Competitors: do not steal our photos. We do check.
  • User-submitted content: If you send us product reviews, photos, or feedback, you grant us a non-exclusive, royalty-free license to use that content on our site and in our marketing. We will credit you unless you ask us not to.
  • Trademarks: PGM, the PGM logo, and PGM product names are trademarks of PGM Golf. Other trademarks appearing on this site belong to their respective owners.

Privacy

How we collect, use, and protect your personal information is detailed on our Privacy Policy page. The short version: we collect only what we need to ship your order, we never sell your data, and we do not run tracking ads. The Privacy Policy is part of these terms.

Third-Party Services

We use trusted third-party services to operate our business:

  • Stripe processes payments. Your card details go directly to Stripe — they never touch our server. Stripe’s privacy policy and terms apply to payment processing.
  • Shipping carriers (USPS, UPS, FedEx) deliver your order. Their terms of service apply to the transit and delivery portion of your order.

We are not responsible for the practices of these third-party services, but we chose them because they are industry-standard and reliable.

Limitation of Liability

FairwayWise is not liable for:

  • Indirect, incidental, or consequential damages arising from the use of our products or website.
  • Delays or failures caused by events beyond our reasonable control (carrier disruptions, natural disasters, manufacturer shortages, customs delays).
  • Injuries resulting from improper use of golf equipment. Golf is a physical sport — use equipment as intended, warm up, and consult a teaching professional if you are unsure about club fitting or swing mechanics.

Our total liability for any claim related to a product you purchased is limited to the purchase price of that product. Nothing in these terms limits liabilities that cannot legally be limited under applicable law.

Disputes

We prefer to resolve issues directly. If you have a problem with your order, our products, or our service, email [email protected] before pursuing any formal action. In nearly all cases, we can work it out.

If we cannot resolve a dispute informally, it will be governed by the laws of the State of New York, without regard to conflict of law principles. Any formal legal action must be brought in the courts of New York County, New York.

Changes to These Terms

We may update these terms from time to time. When we do, we will update the “Last updated” date at the bottom of this page. Material changes will be announced via a notice on our homepage for 30 days. By continuing to use the site after changes take effect, you accept the updated terms.
